AVITA MX
These Terms govern the use of the avitamx.com website. They are not the purchase agreement: every transaction is subject to a formal written quote and to the contract that is signed, documents that prevail over any information published here.
1. Who operates this site and acceptance of the terms
The avitamx.com site and its subdomains are operated by AVITA MX, with its address at Rómulo O'Farril 971, Int. 21B, Col. Centro Cívico, Mexicali, Baja California, C.P. 21000, Mexico (hereinafter, “AVITA MX”).
The sale and installation of units within the territory of the United States of America is carried out through AVITA Modular Homes, LLC, a separate entity with its address at 2127 Olympic Pkwy, Ste 1006-166, Chula Vista, California 91915. Where a transaction corresponds to that entity, this will be stated in the quote and in the corresponding contract.
Accessing and using the site implies full acceptance of these Terms of Use, of the Privacy Notice and of the Cookie Policy. Anyone who does not agree with them should refrain from using the site.
These terms are published in Spanish and in English. In the event of any discrepancy between the two versions, the Spanish version prevails.
2. The site is informational: prices, quotes and specifications
The information published on this site is informational and promotional in nature. It does not constitute a binding commercial offer nor does it oblige AVITA MX to contract on the terms expressed there.
Prices. Prices are expressed in United States dollars and are for reference. They do not include haulage or installation — whose cost depends on the final delivery destination — nor Value Added Tax. They are subject to market changes without prior notice. Published prices apply only to Baja California; Sonora, Los Cabos, Tulum, San Diego and the Imperial Valley are quoted by project.
Quotes. Every transaction is subject to a formal written quote and to the signing of the corresponding contract. Those documents prevail over any information published on the site, including prices, dimensions, timeframes and specifications. A quote is valid for the period stated in it.
Timeframes. Manufacturing, shipping, delivery and installation times are estimates. They depend on factors outside the control of AVITA MX — manufacturing availability, ocean freight, customs clearance, conditions at the installation site and weather, among others.
Technical specifications. Dimensions, materials, capacities, weights, consumption figures and other technical data come from the manufacturers' data sheets. They may be modified by the manufacturer without liability for AVITA MX. Published dimensions are nominal and allow for the tolerances inherent to the manufacturing process.
Availability. Publishing a model does not guarantee its immediate availability nor that it will remain in the catalog.
3. Visual material and images generated with artificial intelligence
The images on this site are illustrative and may differ from the product delivered.
Part of the material consists of digital representations and visualizations generated with artificial intelligence, whose sole purpose is to illustrate possible configurations, settings and surroundings. They do not constitute a representation of the product that is delivered nor of an executed project.
Another part consists of renders and plant photographs supplied by the manufacturers, which show real units from their production. The furniture layout, the finishes and the accessories that appear in them vary according to the configuration contracted and are not understood to be included unless the quote expressly states so.
Layout plans are schematic. They do not replace an executive design project nor review by a licensed professional where the municipality requires one.
The projects identified under the AIRES brand — Aires de Vallecitos and Aires de Tulum — are presented expressly as concept design. They are not developments for sale, they do not constitute a real estate offer and they imply no commitment to build.
4. Permits, land use and local regulations
Requirements vary by municipality and by use, and are the client's responsibility. AVITA MX can advise and accompany the client through the process, but does not guarantee that any license, permit or authorization will be obtained, nor is it liable for refusals, delays or regulatory changes by the competent authority.
Depending on the location, the intended use and the type of project, installation may require a land-use license, a building permit, authorization to connect to services, a civil protection or environmental impact assessment, or compliance with subdivision or condominium regulations.
It is likewise the client's responsibility that the property be suitable: access for the transport and the crane, room to maneuver, levelling, foundations where required, and availability of water, drainage and electrical power. The prior inspection visit offered by AVITA MX is a review of installation feasibility; it does not constitute a soil mechanics study, a structural assessment or a topographic survey.
Any reference on the site to a unit being installed “without construction work” means that it does not require traditional on-site construction, and must not be understood as being exempt from permits or from local regulations.
5. Warranties
The warranty applicable to each unit is the one detailed in the warranty certificate delivered to the client and in the purchase agreement. References to periods or coverage published on this site are informational and do not replace those documents.
The warranty starts on the day of installation and is documented in the delivery file.
Not covered, by way of example and without limitation: normal wear; lack of maintenance; damage from acts of God or force majeure; modifications, repairs or adaptations made by third parties without authorization; relocation or repositioning of the unit by outside personnel; and damage arising from installations, foundations or site preparation carried out by the client or by anyone the client hires.
Like any home, the unit requires normal maintenance by the owner. The extended warranty and additional coverage options mentioned on the site are under development: their availability, scope and cost are confirmed case by case and are not understood to be contracted merely because they appear published.
6. Return analysis and financing
Return analysis. The analysis tool that AVITA MX offers is a decision-making aid. It is built from assumptions supplied by the interested party themselves — nightly rate, estimated occupancy and operating costs — and from hypothetical scenarios. It does not constitute financial, investment, tax or legal advice, nor a guarantee or promise of return. The results are not audited projections. Before deciding, it is advisable to consult your own adviser.
Nothing on this site should be understood as a public offering of securities, nor as an invitation to take part in a collective investment scheme.
Financing in the United States. The financing mentioned applies only to units purchased for installation in the United States of America and is subject to credit approval in that country. It does not apply to purchases installed in Mexico, which are governed by the payment schedules published for each line.
AVITA Modular Homes, LLC does not originate loans and does not make credit decisions. The financing is offered and administered by an independent financial partner, under its own criteria, rates and conditions. AVITA is not a party to that credit relationship and is not liable for it.
Payment schedules. The schedules published for each line are informational. The schedule applicable to a transaction is the one set out in its contract.
7. Intellectual property, trademarks and third-party content
The texts, the structure, the graphic design, the plans, the databases and the code of this site are the property of AVITA MX or are used under license. The AVITA, AVITA MX and AIRES trademarks, as well as their logos, are the property of AVITA MX.
Reproduction, distribution, public communication, transformation or extraction of the site's content, in whole or in part, without prior written authorization, is prohibited. The material may be consulted, downloaded and printed for personal, non-commercial use, keeping the attribution notices.
The site includes images, renders, plans and technical data sheets supplied by the manufacturers, the rights to which belong to their respective owners and which are used with their authorization, within the framework of the commercial distribution relationship. The trademarks of manufacturers, suppliers, partners and third parties that appear on the site belong to their owners and are mentioned solely for informational purposes or to identify the product; their appearance implies no sponsorship or association beyond the commercial relationship that exists in each case.
8. Use of the site, third-party links and limitation of liability
Permitted use. The site must be used in accordance with the law and with these terms. It is prohibited to interfere with its operation, to attempt to access restricted areas, to extract content by automated means, to introduce malicious code, to impersonate third parties, or to submit through the forms any false or offensive information or information about people who have not authorized its use. AVITA MX may restrict access to anyone who fails to comply.
Third-party links and services. The site links to or integrates services operated by third parties — among others WhatsApp, Instagram, Facebook, Google Maps and the forms platform that hosts the site. Those services are governed by their own terms and privacy policies. AVITA MX does not control their content or their availability, and is not liable for them.
Availability. AVITA MX endeavors to keep the site continuously available, but does not guarantee it. It may suspend, modify or take it down, in whole or in part, without prior notice, for maintenance, security or other reasons.
Limitation of liability. To the extent permitted by applicable law, AVITA MX is not liable for indirect, incidental or consequential damages, nor for loss of profits, opportunities or data, arising from the use of or the inability to use this site, or from decisions taken solely on the basis of the information published here. This limitation does not affect the rights that consumer protection legislation grants the client in respect of the products and services actually contracted.
9. Personal data and cookies
The processing of personal data is governed by the Privacy Notice published on this same site, in accordance with Mexico's Ley Federal de Protección de Datos Personales en Posesión de los Particulares (Federal Law on the Protection of Personal Data Held by Private Parties).
The use of cookies and similar technologies, including third-party measurement tools, is governed by the Cookie Policy published on this site.
By submitting a form, the user states that the data is their own or that they are authorized to provide it, and agrees to be contacted to follow up on their request. Sending promotional material requires the express consent collected through the corresponding checkbox, which may be revoked at any time by writing to hola@avitamx.com.
10. Changes, governing law and contact
Changes. AVITA MX may modify these Terms of Use at any time. The version in force is the one published on this site, with the last-updated date shown at the foot. Using the site after a change implies acceptance of it.
Governing law and jurisdiction. These terms are governed by Mexican law. For their interpretation and performance, the parties submit to the jurisdiction of the competent courts of Mexicali, Baja California, waiving any other venue that might correspond to them by reason of their present or future domicile. The foregoing is without prejudice to the rights that consumer protection legislation grants the client, including the competence of the Procuraduría Federal del Consumidor (Mexico's federal consumer protection agency).
Transactions entered into with AVITA Modular Homes, LLC for installation in the United States of America are governed by the law and jurisdiction agreed in the corresponding contract.
